China Harbour Engineering Company Ltd Nauru Sports Center Project
Construction Technology Team

1.2 Project Overview:
The construction site is located on a hill in the Meneng District of Nauru. The site is approximately 290 meters long from east to west and 256 meters long from north to south, with a total area of 59,200 m2 (including 3,200 m2 for roads). The main construction elements of the project include: a basketball gymnasium, athlete entrance lobby, VIP entrance lobby, multi-purpose training hall, gymnasium, weightlifting training hall, boxing training hall, athlete changing rooms, referee changing rooms, management offices, VIP boxes, public restrooms, fire safety and security control room, medical room, massage room, and storage areas.

2. Tender Content
China Harbour Engineering Company Ltd. (Abbreviation: CHEC, hereinafter referred to as the "Tenderer") is conducting an open tender for the procurement of Steel Casing Pipes (660 tons, tentative). Details are specified in Part II of this document – List of Materials for Tender.

Special Note: The purpose of this tender and the subsequent contract negotiations is for the Tenderer to finalize the material specifications, pricing, and after-sales service plan. The quantity stated in this tender is provisional; the final purchase quantity shall be subject to the Tenderer's notification.

Design Changes and Tender Handling Clause
The technical specifications, bill of quantities, and related parameters for this tender are prepared based on the current design documents.

During the tender process, if substantial changes occur to the technical specifications, key parameters, quantities, or implementation conditions of the steel casing pipes due to design optimization, approval adjustments, or actual project requirements, which significantly impact the basis of bid pricing or the tender evaluation outcome, the Tenderer reserves the right to lawfully terminate this tender activity and re-initiate a new tender based on the latest design documents.

If design changes do not constitute substantial changes, the Tenderer may proceed with the current tender by issuing supplementary notices, clarifications, or requesting bidders to adjust their quotations.

Bidders must fully consider the aforementioned risks. The Tenderer shall not bear any compensation or liability for any bidding costs incurred by bidders due to termination, invalidation, or re-tendering caused by design changes.

3. Bidder Qualification Requirements
The bidder must be an independent legal entity with a fixed business address.
The bidder must be a professional manufacturer capable of fulfilling the tender requirements and supplying the tendered goods and services.
This tender does NOT accept bids from consortiums or agents.

Production Capacity Requirement: Must meet the supply requirements of this project.
Financial Capability Requirement: Financial status must not be under receivership, frozen, or bankrupt. Audited financial statements for the past three years must be provided.
Quality Assurance Requirement: Must comply with an ISO Quality Certification System.
Supply Performance Requirement: Priority will be given to bidders who can provide proof of at least three (3) supply cooperation records with CCCC or China Harbour (CHEC) between 2022 and 2024 (the past three years).
Performance Credit Requirement: Must provide relevant creditworthiness documents with no negative records.
Other Requirements: The manufacturing of the steel casing pipes in this batch can only commence after the successful completion of the tender, the identification of the winning bidder, and upon receipt of an official procurement notice (備貨函) from the Client (Party A).

Different entities whose legal representatives are the same person, or which have controlling, or managerial relationships, are not permitted to submit bids simultaneously for this tender. Otherwise, all related bids will be rejected.
In previous similar procurements by China Harbour or related enterprises, the products supplied by the bidder must not have had serious quality or service issues.

A bidder will be deemed to have submitted an invalid bid if found in any of the following circumstances:
(1) Is an affiliate of the Tenderer without independent legal status, or has an interest relationship with the Tenderer that may affect the fairness of the tender;
(2) Has been ordered to suspend business, or has had its license/permit suspended or revoked;
(3) Has been suspended or disqualified from tendering;
(4) Has assets under receivership, frozen, in liquidation, or the enterprise is in a state of shutdown, suspension, cessation of business, bankruptcy, or other loss of performance capability;
(5) Has been involved in winning a bid by fraud, serious breach of contract, or major quality issues within the last three years;
(6) Is involved in ongoing litigation which, in the judgment of the Tender Evaluation Committee, would significantly impact its ability to undertake this project;
(7) Is listed in the "Abnormal Operations List" or "Seriously Dishonest Enterprises List" on the National Enterprise Credit Information Publicity System (www.****.cn). A screenshot of the query result must be provided in the bid documents, stamped with the bidder's official seal;
(8) Is listed as a "Discredited Entity Subject to Enforcement" or on a "Dishonesty Blacklist" on the "Credit China" website (www.****.cn). A screenshot of the query result must be provided in the bid documents, stamped with the bidder's official seal;
(9) The bidder, its legal representative, or the proposed project manager has been involved in bribery crimes within the past three years (as verified by query results from the relevant Procuratorate department);
(10) Other circumstances stipulated by laws, regulations, or the preamble to the Instructions to Bidders;
(11) Supplied products of a similar type in previous procurements by China Harbour or related enterprises which had serious quality or service issues;
(12) Fails to prepare bid documents as required, including missing stamps or signatures where required.

Import Restrictions
The materials and related after-sales services offered by the bidder must originate from eligible source countries not subject to import restrictions in Nauru. Payment under any contract will be limited to such materials and services.

Bidding Costs
The bidder shall bear all costs associated with the preparation and submission of its bid. The Tenderer shall not be liable or responsible for these costs under any circumstances, regardless of the tender's outcome. (There is no fee for this tender document.)

2、招标内容

中国****公司(英文缩写CHEC,以下简称招标人)以公开招标的方式采购 钢护筒(660吨) ,具体内容见本文件第二部分——招标物资清单。

特别说明:招标人通过本次招标及随后的合同谈判,锁定物资型号、物资价格及后期的售后服务方案。本次招标的数量为暂定数量,具体采购数量以招标人通知为准。

设计变更及招标处理条款

本次招标所依据的技术规格、工程量清单及相关参数均以现阶段设计文件为基础编制。

在招标过程中,如因设计优化、审批调整或工程实际需要,导致钢护筒的技术规格、主要参数、工程数量或实施条件发生实质性变化,并对投标报价基础或评标结果产生重大影响的,招标人有权依法终止本次招标活动,并根据最新设计文件重新组织招标。标书代写

若设计变更未构成实质性变化,招标人可通过发布补充通知、澄清文件或要求投标人调整报价的方式继续本次招标。

投标人应充分考虑上述风险,因设计变更导致招标终止、废标或重新招标的,投标人自行承担已发生的投标费用,招标人不承担任何补偿或赔偿责任。

3、、投标人资质要求

投标人必须具有独立法人资格,有固定的营业地址。

投标人必须是有能力履行招标内容要求和提供招标货物及服务的专业制造商。

本次招标不接受联合体和代理商投标。

生产能力要求:满足本项目供货要求。

财务能力要求:财务没有被接管、冻结、破产状态,出具近三年会计审计报表。

质量保证能力要求:符合ISO质量认证体系。

供货业绩要求:投标人若出具近3年2022年至2024年内至少有3个中交或中国港湾的供货**业绩,并能提供相关证明文件的优先考虑。

履约信用要求:有相关信用证明材料,无不良记录。

其他要求:本批钢护筒待完成招标,确定中标人后,由甲方以备货函的形式通知中标人后,方可进行钢护筒的加工。

投标人单位负责人为同一人或者存在控股、管理关系的不同单位,不得同时参加投标,否则,相关投标均被否决。

既往中国港湾或相关企业的类似采购,投标人供应的产品未出现过严重质量或服务问题。

投标人不得存在下列情形之一,将被视为无效投标:

(1)为招标人不具有独立法人资格的附属机构(单位), 或与招标人存在利害关系且可能影响招标公正性;

(2)被责令停业、暂扣或者吊销许可证、暂扣或者吊销执照;

(3)被暂停或取消投标资格的;

(4)财产被接管、冻结、进入清算程序,或企业处于停产、停业、歇业或破产状态,或其他丧失履约能力的情形;

(5)在最近三年内有骗取中标或严重违约或重大质量问题的;

(6****委员会认定会对承担本项目造成重大影响的正在诉讼的案件;
